Comment on the evaluation of the EU Dual-Use Regulation (EU) 2021/821
The evaluation of the EU Dual-Use Regulation should focus on enhancing legal certainty, reducing administrative burdens, and improving regulatory efficiency, rather than pursuing a fundamental overhaul of the existing framework. The BDI supports effective export controls that safeguard security and non-proliferation objectives while simultaneously strengthening legal certainty, technological innovation, and the international competitiveness of European industry. Key priorities include modernising the rules governing intangible technology transfers, placing greater emphasis on control lists rather than catch-all controls, and regularly removing outdated or no longer security-relevant restrictions to reduce bureaucracy and ensure that regulatory efforts remain focused on genuinely sensitive technologies.
