Significant problems continue to arise in the use of electronic invoices (e-invoices). Therefore, the prompt resolution of implementation issues is of paramount importance. Legal uncertainty and additional bureaucratic burdens must be avoided in order to achieve broad acceptance of e-invoices.

Digitalization and AI in Tax Law
The transition to a tax system that is compatible with the digital age is one of the most pressing challenges in tax policy. In Germany, there is a significant need for action. Given the limited resources available to both businesses and tax authorities, far-reaching improvements and progress are now necessary.
At the BDI’s “Tax Forum Berlin 2025,” the innovative potential of artificial intelligence (AI) for using big data in the tax sector was highlighted. The event showcased efficiency-enhancing applications, such as targeted knowledge transfer and support with data analysis, and explored key prerequisites and potential pitfalls.
The BDI has developed a comprehensive reform proposal for the tax treatment of non-cash benefits. The existing rules are complex and create a considerable administrative burden. The BDI’s reform proposal aims to introduce a low-bureaucracy flat-rate taxation system designed, in close consultation with businesses, to support fully digital processing.
Künstliche Intelligenz (KI) steht an der Schwelle, das Besteuerungsverfahren grundlegend zu verändern. Die sehr weitreichenden Einsatzmöglichkeiten von KI-basierten Systemen eröffnen sowohl den Steuerpflichtigen als auch der Finanzverwaltung enorme Potenziale zur Effizienzsteigerung. Der BDI geht in einem neuen Positionspapier „Einsatz künstlicher Intelligenz im Besteuerungsverfahren“ näher dazu ein.
Schon im Gesetzgebungsprozess ist die digitale Umsetzung und Befolgung neuer Steuerrechtsnormen essenziell. Seit Anfang Januar 2023 erfolgt der Digitalchecks durch den Nationalen Normenkontrollrat im Rahmen seines gesetzlichen Auftrags. Ziel muss es sein, dass die digitale Umsetzbarkeit ein fester Bestandteil eines jeden steuerlichen Gesetzgebungsverfahrens ist.
Die Umstellung auf ein digitaltaugliches Steuerrecht ist eine der vordringlichen steuerpolitischen Herausforderungen. In Deutschland besteht erheblicher Handlungsbedarf. Angesichts der knappen Ressourcen sowohl in Unternehmen als auch in der Finanzverwaltung sind jetzt weitreichende Verbesserungen und Fortschritte notwendig.
Companies have long submitted their tax returns electronically. However, tax assessment notices are, as a rule, still generally sent to companies by the tax authorities on paper. Such breaks between digital and paper-based processes are prone to error and no longer fit for purpose. By contrast, an end-to-end digital tax assessment process makes procedures more efficient for both companies and the tax authorities.
Greater efficiency gains for businesses and tax authorities can be achieved by further digitalizing tax audits. As a result, more timely audits enable businesses to obtain legal certainty sooner.
